When Does The Law, Violate The Law?

Tennessee speeders could get fingerprinted

Motorists stopped for traffic violations in Tennessee could be fingerprinted if state lawmakers approve a bill pending in the legislature.

Currently, when drivers are cited during traffic stops, police officers ask for the driver’s signature on the ticket, but the proposed bill would allow police departments to eliminate signatures and collect fingerprints.

Supporters say collecting fingerprints would save money and help police determine whether the driver is wanted for a criminal offense, but opponents worry that it allows the government to tread on individual privacy rights.

This kind of bill brings up all kinds of questions. On the one hand, law enforcement would be able to discover if the person they stopped for speeding has any warrants out on them, or is wanted in connection, or questioning, or whatever, but then, they can do that when they run their name and license, right? Assuming of course, they give their REAL name, and the license isn’t a forgery. On the other hand, this is an invasion of privacy. Being forced to give your fingerprints? For a speeding ticket? Not a real good idea.

Obviously, I’m no lawyer, and I’m sure not a Contitutional lawyer, don’t even play one on TV, but it seems to me, this would be a violation of the 4th Amendment of the U.S. Constitution:

The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

And a violation of Sec. 7 of the Tennessee Constitution:

That the people shall be secure in their persons, houses, papers and possessions, from unreasonable searches and seizures; and that general warrants, whereby an officer may be commanded to search suspected places, without evidence of the fact committed, or to seize any person or persons not named, whose offences are not particularly described and supported by evidence, are dangerous to liberty and ought not to be granted.

Being forced to provide your finger prints, for a speeding ticket doesn’t quite mesh with that being ‘secure in their persons’ part, and is ‘dangerous to liberty’.

There will be some who say, “well, if they aren’t speeding….breaking the law….they have nothing to worry about, right?”  That may be true, but who’s to say they won’t take it even farther.  How about crossing the street against the light?  Should you be fingerprinted for that?  How about letting the parking meter expire?

State Sen. Joe Haynes and State Rep. Mike Stewart co-sponsored the bill, which gives police departments the choice of collecting a signature or a fingerprint, or collecting a signature and a fingerprint. The bill has been approved by the state House of Representatives, and senators will vote on the measure Wednesday.

I notice the party affiliation was left off, so I looked these guys up. What a surprise! They are both Democrats. The Tennessee legislature website doesn’t give party affiliation for the rep who vote, but I did discover that my state rep, Vance Dennis, was bright enough to vote “NO”.  That brings him back up a notch or two.  As best I can figure, my state senator, Delores Gresham, didn’t vote at all?  :?   Maybe I’m just confused.

“This police department (Nashville) intends to use the fingerprint the same way as a signature is currently used,” Metro police spokesman Don Aaron said. “If a person who has stolen someone’s identity gives a wrong name, an officer will be able to catch that immediately. And, if they have an outstanding warrant, be it for a misdemeanor or a serious felony, an officer will be able to see that as well.”

Yes, as I said, there is a plus side to this bill, but…..

If police departments use the fingerprints as Metro intends, then that’s enough reassurance for Hedy Weinberg, executive director of the Tennessee chapter of the American Civil Liberties Union.

Well, if the ACLU is for it, then, golly gee….. (insert massive sarcasm here)

“As long as the police department is ensuring that it will not create a database using the fingerprints collected on traffic citations and that those fingerprints will be used only to identify the person being stopped and for no other purposes,” Weinberg said, “then the police department appears to be using the technology appropriately.”

Is she serious? This is the bunch that defends pedophilia, but won’t stand up for the 1st Amendment when it comes to Christians? I think I’ll have to pass.

But Rep. Stacey Campfield, a Knoxville Republican, is skeptical and takes issue with the legislation. “If someone said this 15 to 20 years ago, people would be rioting about it. Now it just seems like a lot of people are giving up and giving away their freedoms,” Campfield said. “It’s scary. I really think that these fingerprints will be used to create a database eventually, if not right away. If you don’t think it is, then you’re just kidding yourself.”

Smart guy, that Stacey! Wish we had more like him! And I agree. People would have taken to the streets, but no longer. They just continue to hand over all their rights to a government entity, and say, “Take care of me.”

I find it amazing that the people in this country, daily, are giving up everything that was so hard won. Blood was shed to give them those rights, and they toss them away like they were nothing.  Even their own fingerprints. Make no mistake! This will escalate, and they will be tracking you. We may, or may not, have the technology now, but there will come a day when you will have to give your fingerprint to even buy a can of beans, or even use a public toilet.

I guess the sentiment of Pastor Martin Niemöller’s poem could apply here as well. They came for the speeders, but I don’t speed, so it was no concern of mine. When will it be our concern? When there is no one left to shout to the rafters that this is wrong?  No, I’m not equating traffic tickets with Nazi Germany.  I’m equating the lack of action of rational people, to allow these types of bills, that obviously are a violation of liberties, to continue.  All it takes is one step.

Listen To The People, Not The Politicians

Republican recruiters tilting toward the center in 2010 races

Dick Cheney and Rush Limbaugh contend the Republican Party needs less moderation and more conservative backbone to win back voters who have been abandoning it in droves.

I know I’m one of those ‘droves’. I know of quite a few others who have let it be known they will not be supporting any RINOs, or moderate Republicans.

Leaders of the party’s 2010 election efforts are showing they don’t think ideological purity is the answer.

They might want to rethink that stand, if they expect people to support them.

In the latest example, key Republican senators jumped this week behind the Senate candidacy of centrist GOP Gov. Charlie Crist of Florida, picking sides a year before the party primary even though another well-established candidate, former state House Speaker Marco Rubio, has stronger conservative credentials.

Crist is not a conservative. He proved that by standing with B. Hussein, supporting the bailout BS. Given such a choice, will Florida a conservative, or buy into the same ol’ horse manure. I’d like to think folks in Florida are just as fed up as the rest of us. I’ve seen some indication of this being the case.

Almost immediately after Crist launched his campaign Tuesday, an influential conservative blogger, Erick Erickson, asked readers to join a new Web-based group called “Not one penny to the National Republican Senatorial Committee.”

I joined. :) On the same day, I returned my most recent “gimme money” from the RNC with the Charter Member 2009 membership card, with a little note above the $ amounts: “I DON’T BLOODY WELL THINK SO!” Think they’ll take me off their mailing list now? :D

“I think the party is continuing to not get it, and they’ll continue to lose elections if they keep acting in bad faith like this,” said John Stemberger, a conservative activist who runs the Florida Family Policy Council. “This race in the primary is really going to be a battle for the heart and soul of the party.”

Obviously, they ‘don’t get it’! It’s been proven….conservatism wins. Standing firm on your principles does not mean compromise just to bring in more members and money.

But on Capitol Hill, Republicans such as Senate Minority Leader Mitch McConnell of Kentucky and former presidential candidate John McCain of Arizona joined NRSC Chairman John Cornyn of Texas in singing Crist’s praises. Sen. Mel Martinez, the retiring Florida Republican whom Crist would replace, went so far as to encourage Rubio to get out of the race.

And there ya have it! If John McCain is ‘singing his praises’, that pretty much does it! /snark Uh huh….anyone wonder why McCain fell flat on his face in 2008? Because he’s one of those compromising RINOs that people just couldn’t get behind. If this is the future of the Republican Party, they might as well pack their bags and go home, cuz they are going to keep losing elections, quite possibly due to 3rd party voters who are fed up!

The more that woman flaps her plastic lips, the more of an ass she makes of herself, and the more she embarrasses the whole country. If the people in her district had any sense, which I rather doubt, since they keep re-electing her, they’d start an immediate recall effort! Unfortunately for the rest of us, she’s the face of Congress, the face the world sees as the leadership of what was once a respected body of legislators.

Please!  For the sake of the sanity of the nation…..give her some Prozac and Premarin, and send her sorry hind end back to her vineyards!

Jordan king to Netanyahu: Israel must accept Palestinian state

Jordan’s king pressed Prime Minister Benjamin Netanyahu on Thursday to immediately commit to the establishment of a Palestinian state, as the monarch pursued a sweeping resolution of the Muslim world’s conflicts with Israel.

King Abdullah II made the comments during a meeting in the Red Sea city of Aqaba with Netanyahu, who made an unannounced, lightning visit to neighboring Jordan. He urged the Israeli leader to immediately declare his acceptance of the Arab peace initiative and to take necessary steps to move forward toward a solution, according to a royal palace communique.

The statement did not give Netanyahu’s response, and a spokesman for the Israeli leader was not immediately available for comment.

We went to Aqaba, on our way to Petra, in Jordon. Big fancy city, lots of new building going on, plenty of room for growth. Come to think of it, there are long stretches of area in Jordon with plenty of room for growth. So, I have to ask…why doesn’t the King of Jordon take in those folks he so worried about? He doesn’t want them either, even though they were flying the “Palestinian flag”……”in solidarity with their ‘brothers’”.

You see that itty bitty stretch of purple?  That’s Israel.  Right next door is Jordon.  Up in the right hand corner is Syria, to the left is Egypt, and that great big area on the southern tip is Saudi Arabia.  Lebanon isn’t very big at all, so that’s not really an option.

Now, the reason I bring this up…..if the Arab world is so concerned about their “Palestinian brothers”, why the hell don’t they open their doors, and welcome them in?  Well, I’ll tell ya why…..they don’t want them.  In all reality, none of them give a happy crap about those people.  What they ARE concerned about is a strong Jewish state!  If the Israelis weren’t constantly battling within their own borders for survival against the terrorists, they could be even stronger, and the Arabs don’t want that, do they.

There will be some who will say that the Jews kicked families off their land, basically stole it.  Well, from what I saw, and have learned, the Israelis offered to live in peace with many of those families, and were turned down.  Yes, there were some, who wanted all Arabs out of the area, but considering the Grand Mufti was a ‘friend’ of Adolph Hitler, can you blame them?  The Arabs would rather slaughter them than live peacefully.  Israeli-Arabs have basically the same rights living in Israel as do Israeli-Jews.  What’s the problem?  They are Jews, and through centuries of indoctrination, because they wouldn’t bow down to false prophets (aka Mohammed), Muslims have been taught that Jews (the People of the Book) are evil, and must be destroyed.  Then again, they are taught the same thing about Christians.

When the Jews returned to Israel after WWII, there was pretty much nothing there.  The desert bloomed, and is still blooming.  The contributions of the state of Israel are so vast, most people don’t even realize they are using many of the things that have come from there.  What was being contributed to the world BEFORE the establishment of the country?

Netanyahu will likely hear a similar message when he meets President Barack Obama in Washington on Monday.

The U.S. says moderate Arab states such as Jordan will not join a united front against Tehran unless Israel moves vigorously on peacemaking.

To be perfectly honest, I don’t believe for one minute that any so called ‘moderate Arab states’ would aid Israel in any way, shape, or form. IF they were serious about stopping Iran, they could have done so a long time ago, yet….they’ve done NOTHING!

No, Israel won’t be surprised to learn that this current resident of the American White House is not a friend, and will not back them in their quest to remain safe from the ever growing threat. But then, neither am I.

Barack Obama promised that he wouldn’t raise taxes on anyone making less than $250,000 a year. He neglected to mention that this tax exemption would go only to those who don’t use electricity, gasoline, heating oil or natural gas.

The truth of the matter is that Obama will raise taxes on practically all middle-class Americans. But that’s not all; in addition to new taxes on all those necessities (just think of all the appliances in your home that use electricity), he will drastically reduce our standard of living.

Obama warned during his campaign in Oregon that we can no longer keep our homes set at 72 degrees (warmed in the winter and cooled in the summer), eat whatever foods we want (if meat and milk products come from cows that have to be fed) and drive SUVs (to accommodate our family and friends). He said we shouldn’t continue to consume 25 percent of the world’s resources when we have only 4 percent of the world’s population.

Déjà Vu All Over Again

By now you have probably noticed that illegal immigration is a hot-button issue for me.  While I know there are probably law abiding (relatively speaking, since they broke the law by entering illegally) folks out there who really do want a better life, I am sick and freaking tired of reading stories like this one.

Breanna Schneller’s cell phone led authorities to a Rib Mountain restaurant in search of her killer. Video surveillance tapes led them to question Raul Ponce-Rocha. But his own statements and DNA ultimately led to Ponce-Rocha’s arrest, authorities say.

Ponce-Rocha, a 22-year-old illegal immigrant living in Wausau, is expected to be charged today in the May 2 stabbing and beating death of the D.C. Everest High School senior.

He has been in custody since May 6 in connection with Schneller’s homicide at a 12th Avenue apartment building on Wausau’s west side. Authorities say they recovered two knives from inside the apartment where Schneller, 18, lived with her fiance and his brother.

Preliminary DNA results received Monday from the state Crime Lab linked Ponce-Rocha to the crime, Wausau Police Chief Jeff Hardel said during a news conference Tuesday. Detectives are continuing to investigate the motive for her death, Hardel said.

Schneller suffered multiple stab wounds to her head, chest and neck in an attack in her bedroom, where her fiance’s brother found her body lying on the floor, according to the criminal complaint. Police said she had not been sexually assaulted, but the complaint said her halter top had been pulled down.

Ponce-Rocha is scheduled to make an initial appearance today in Marathon County Circuit Court on a first-degree intentional homicide charge, Assistant District Attorney Theresa Merriwether said.

Police reported Ponce-Rocha to federal authorities after an interview in which detectives noted discrepancies in his answers, Hardel said. Ponce-Rocha remained in custody Tuesday on an immigration hold by U.S. Citizenship and Immigration Services at the Dodge County Jail. Dodge County has a contract with the federal government to hold people with immigration issues.

Evidence containing Ponce-Rocha’s DNA was found inside a pair of mis-matched gloves and a plastic bag that contained the gloves, according to a police report. Also inside the plastic bag were two pairs of Schneller’s underwear and her cell phone.

You can read the rest at the link above.  My rant on this post holds still holds true.  Another young life taken far too soon by someone who is a) an illegal immigrant and b) has been previously charged with crimes.  This is an all too familiar story.  This time however, the judge, in an unusual display of common sense, set the bail at $1 million.  This, in my humble opinion, is too little, too late.  I hope the judges and prosecutors that dealt with this POS in previous matters see Breanna Schneller’s face in their dreams.

Illegal Immigrant on Trial

Go figure – another illegal kills someone by driving drunk- this time a child.

An illegal immigrant being tried in North Carolina this week for murdering a 7-year-old boy had been previously arrested and charged with drunken driving five times

Incredibly, the illegal alien (Hipolito Hernandez) was repeatedly released from custody and last spring ran over the Four Oaks boy while driving intoxicated in a stolen car. The boy was trying to cross the roadway in front of his grandmother’s home when the drunken Hernandez ran off the road onto a curve at 70 miles per hour and plowed into him. 

Police determined that Hernandez had a blood alcohol level more than twice the legal limit and witnesses testified that he fled on foot from the crash scene without bothering to check the boy’s condition. He was arrested about an hour later with the help of a Good Samaritan. 

This week the illegal alien, who has several aliases, is finally being tried in Johnston County for second-degree murder, felony hit and run, felony assault, driving while impaired, reckless driving, operating a stolen motor vehicle, and driving without a license.

This tragic case is the result of sanctuary policies adopted by cities and counties nationwide to protect illegal immigrants from deportation. North Carolina has four known illegal immigrant sanctuaries—Charlotte, Durham, Raleigh and Winston—and many others that have similar hands off policies regarding immigration.

Now I ask you – why the HELL was he repeatedly released from custody?  Why the HELL was this jackass still driving?  Most importantly, why the HELL was this POS still in this country??  And for all of you who claim that most illegals are just trying to make a better life, cut the crap.  There is no shortage of stories about these slimeballs driving drunk, robbing, stealing, raping and killing.  And yes, there are no shortage of people who are not here illegally who do the same thing, but the difference is they are US CITIZENS. 

Ya know, this idiotic administration of ours wants to dictate and legislate when, where and how much we eat, drink and smoke, and yet nothing is being done about this.  Contrary to what Mzzzz. Napolitano says, coming into this country illegally is a CRIME. 

Ya know, there was a story a couple of years ago about a Kenosha County Deputy who was killed by an illegal who had been deported and was back.  For the sake of the the family of the Kenosha deputy, for the sake of the parents of this 7-year-old, for the sake of all loved ones who fall victim to those who shouldn’t be in the country to begin with, please, please let’s CLOSE THE GODDAMN BORDER!!!

I think my head just exploded.

If You Tell A Lie Often Enough….

There is no consensus among scientists about the exact reasons that an individual develops a heterosexual, bisexual, gay, or lesbian orientation. Although much research has examined the possible genetic, hormonal, developmental, social, and cultural influences on sexual orientation, no findings have emerged that permit scientists to conclude that sexual orientation is determined by any particular factor or factors. Many think that nature and nurture both play complex roles; most people experience little or no sense of choice about their sexual orientation.

No scientific conclusion?  Well then….how ’bout stop spreading the tired propaganda that “they can’t help it”, “it’s biological”?
