The Danger of Article 82 and Obama’s Latest Treaty

Back in 1982, President Ronald Reagan decided not to sign a treaty known as “Law of the Sea” (LOST), a United Nations convention that would raid America’s treasury for billions of dollars, then redistribute that wealth to the rest of the world by an international bureaucracy headquartered in Kingston, Jamaica. But today, the Obama Administration has revived that treaty, and tomorrow Senator John Kerry (D-MA) will hold hearings designed to illustrate its supposed benefits and generate support for its ratification. Without a doubt, Reagan’s decision should stand, and LOST should remain relegated to the trash bin of history.
The rationale for LOST is that it supposedly brings order to the world’s oceans, defines the rights and responsibilities of nations as they navigate and conduct business across the seas, protects the marine environment, and allows for the development of natural resources of the deep seabed. On the surface, these all sound like worthwhile goals. The thing is, the United States doesn’t need to join another United Nations treaty to make it happen.
For more than 200 years before LOST was adopted in 1982 and for 30 years since then, the U.S. Navy has successfully protected America’s maritime interests regardless of the fact that the United States has not signed on to the treaty. The United States’ navigational rights and freedoms have been secure, and they are best guaranteed by a strong Navy.
LOST is not without consequences, either. One of the more nefarious and insidious of its provisions is Article 82, which requires the United States to forfeit royalties generated from oil and gas development on the continental shelf beyond 200 nautical miles – an area known as the “extended continental shelf.” That money, which one estimate says could be worth many billions, if not trillions of dollars, would go to the International Seabed Authority, a new international bureaucracy created by the treaty and based in Jamaica. Heritage’s Steven Groves explains that from there, America’s money could be shipped to the Middle East, Africa, China, and even state sponsors of terror:
LOST directs that the revenue be distributed to “developing States” (such as Somalia, Burma … you get the picture) and “peoples who have not attained full independence” (such as the Palestinian Liberation Organization … hey, don’t they sponsor terrorism?). The assembly – the “supreme organ” of the International Seabed Authority in which the United States has a single vote to cast – has the final say regarding the distribution of America’s transmogrified “international” royalties.
The assembly may vote to distribute royalties to undemocratic, despotic or brutal governments in Belarus, China or Zimbabwe – all members of LOST. Perhaps those dollars will go to regimes that are merely corrupt; 13 of the world’s 20 most corrupt nations, according to Transparency International, are parties to LOST. Even Cuba and Sudan, both considered state sponsors of terrorism, could receive dollars fresh from the U.S. Treasury.
In addition to shipping America’s money overseas to unsavory recipients, LOST could have other negative consequences, as well, by exposing U.S. industry and manufacturing to baseless international lawsuits. In fact, environmental activists and international legal academics are actively exploring the potential of using international litigation against the United States to advance their agendas. And for those who say LOST is a tool for mediating international disputes, take a look at the Philippines, which signed on to the treaty and yet today is finding itself browbeaten by China and its claims in the South China Sea.
If America truly wants to preserve its rights on the sea, then it needs to bolster the one tool that has guaranteed those rights throughout history — a strong U.S. Navy. Unfortunately, under President Obama’s watch, the United States is seeing its fleet diminished in size and ability. A lone piece of paper will not defend America’s interests on the sea, and neither will transferring billions of dollars to an international authority in Jamaica for redistribution the world over. LOST should not be ratified and signed, and instead Washington should turn its attention to ensuring that the U.S. Navy has the resources it needs to protect America’s interests on the high seas.

A Force for Liberty from China to Cuba

On Saturday night, blind Chinese legal activist Chen Guangcheng arrived in Newark, N.J., after escaping seven years of persecution in China. With the sweet land of liberty under his feet, Chen breathed the free air and remarked, “We should link our arms to continue in the fight for the goodness in the world and to fight against injustice.” Chen’s newfound freedom is a cause for celebration, but it is also a reminder that America must continue to be a force for liberty in the world, whether on the other side of the world or 90 miles off the shores of Florida.
A 40-year-old self-taught lawyer, Chen was imprisoned for four years, placed under house arrest and suffered beatings after voicing opposition to communist China’s one-child policy, which brings with it government-forced abortions, coerced sterilizations, and fines or physical abuse for neighbors and family members of women with unauthorized pregnancies. Last month, he escaped the grip of Chinese authorities and found refuge in the U.S. Embassy. After a series of negotiations, Chen and his immediate family won their freedom — he is now a legal fellow at New York University Law School.

America’s flying fortress, the Cold War-era B-52 bomber, has been in service for the last 50 years, running missions in Vietnam, Operation Desert Storm, Afghanistan and the war in Iraq. It’s a striking example of how America’s military is being forced to do more with less, relying on decades-old technology to confront today’s challenges. Unfortunately, the B-52 is only one example of the United States’ geriatric fighting force, and with mounting cuts to the military, America’s ability to defend itself is increasingly called into question.

A Glimmer of Hope for the American Dream

Yesterday in the Senate, America bore witness to the glaringly obvious division in Washington, as stark as the contrast between high noon in the desert and midnight in the mountains. On the one hand is Majority Leader Harry Reid’s (D-NV) failure to pass a budget over the past three years. And on the other hand is leadership from conservative senators and representatives who have put forward serious proposals to rescue America from its debt and spending crises.
That division was laid bare inside the Capitol yesterday afternoon as the U.S. Senate voted 99-0 against President Barack Obama’s budget — a plan that spends more, taxes more, and slashes our military, all without making any attempt to reform America’s entitlement mess.
Compare the President’s proposal — and Reid’s total lack of a proposal — with the four plans offered by conservatives in Congress, chief among them being Senator Mike Lee’s (R-UT) budget, which mirrors the bold and thorough reforms The Heritage Foundation first proposed in its Saving the American Dream plan. That includes limiting the size of the federal government, reforming entitlement programs, and simplifying the federal tax code in an effort to restore our nation’s economic prosperity and ensure that future generations are not saddled with today’s debt.

This is a sentiment President Barack Obama did not inherit from his predecessor. Over the past month we have witnessed several displays of arrogant power emanating from our White House, emphasizing fealty to a person over the integrity of an American institution. Some are more serious than others.
First, this week it was discovered that White House staff had edited the biographies of many past presidents on whitehouse.gov to include a bullet point or two inserting President Obama into each historical narrative.

The lingering headline on the front pages this week is that JP Morgan Chase suffered a massive loss on a hedging strategy, costing them $2 billion. That’s no small mistake, and it’s an example of how bad decisions in the free market can cost big money. But just because mistakes have consequences doesn’t mean that the mighty hand of government needs to step in to save us from ourselves. However, that’s what some on the left are now calling for.
The news of this blunder hit last week when JP Morgan CEO Jamie Dimon revealed that the bank took a $2 billion loss over the past six weeks in a strategy intended to hedge against risks to the bank’s assets that could come from market volatility caused by the Euro crisis. On Sunday’s Meet the Press, Dimon admitted, “In hindsight, we took far too much risk. The strategy we had was badly vetted. It was badly monitored. It should never have happened.”

It has been over three years (1,111 days to be precise) since the U.S. Senate last passed a budget. The last time Senate Majority Leader Harry Reid (D-NV) fulfilled his legal responsibility, Conan was still on NBC, Tea Parties hadn’t come together and the iPad hadn’t yet been introduced. This is one of the biggest abdications of power we have seen on the part of our government in modern time. And there is no excuse. The Senate needs only 51 votes to pass a budget. Democrats have had well over that for President Obama’s entire term, yet they refuse to even offer a plan.
Let’s be clear. The Senate must pass a budget if we are going to halt Washington’s disastrous habit of overspending, overborrowing and overtaxing our fragile economy. While liberals sit on the sidelines saying ‘no,’ conservatives are offering solutions.
Representative Paul Ryan (R-WI), Senator Pat Toomey (R-PA) and others have courageously put credible and thoughtful plans on the table. But today, I am happy to report that a member of the Senate has put forward an unprecedented new plan that directly confronts all of the major economic challenges our nation faces.

Stopping the Largest Tax Hike in History

The largest tax hike in history is due to strike the United States on January 1, 2013. Known as “Taxmageddon,” it would impose $494 billion in higher taxes on the American people in the first year. So terrible would be its impact that yesterday Fed Chairman Ben Bernanke warned Senate Democrats that the country is headed toward a “fiscal cliff” and that Congress must deal with the impending tax nightmare.
On Wednesday, House Speaker John Boehner (R-OH) announced that his chamber will take up the issue before the November election. Knowing Washington’s general reluctance to do anything of substance in an election year, Boehner’s announcement was welcome news given the disastrous ramifications the threat of such a massive tax hike is already having on the economy. That’s according to Mohammed El-Erian, CEO of Pimco, the world’s largest bond trading firm. El-Erian argues a “prolonged political inaction is likely to postpone building plants and purchasing equipment and to discourage them from hiring.” And that is only an inkling of the blow that would strike the economy if these tax hikes actually took effect.

Is the Pentagon going to stand up for our military? Will that so called Secretary of Defense, Panetta, speak out against making such irrational cuts? Or, will they do what they always do….not a DAMN thing! Isn’t it time for US to speak out in support of our fighting men and women? If there was war on our shores, would Washington be so quick to leave the military without the necessary equipment? When it comes to saving their sorry asses, I’m pretty sure our soldiers would have everything possible to keep them safe! How ’bout y’all pretend there is a battle, a HUGE fire fight going on in YOUR front yard, will you cut defense spending then? The war on terror is NOT over. It will never be over until the evil is eradicated! You people actually INVITE it in, and wonder why people are so pissed off? Get a grip! If you jack wagons have to do without your tax funded salaries, your perks, and those fancy cars, then… DO IT! None of you need the income! The military DOES! Now, pull your heads out of your asses, and fund our military with EVERYTHING they need! That IS, after all, your job! To make sure the citizens of this country are safe! Our military are citizens too! It is NOT your job to fund stupid pork projects. READ THE DAMN CONSTITUTION! It has your job description in there. Very simple. Anything beyond that, you are overstepping your bounds. I repeat, pull your heads out of your asses. Our survival depends on those in uniform….NOT YOU! YOU are irrelevant!
Would You Take an SUV into Combat?

Should our fighting men and women be forced to drive unarmed SUVs into war zones, with speed as their only defense against rocket and car bomb attacks? Tragically, that’s a true story of U.S. military readiness today, and America’s defenses will only get worse under the drastic cuts aimed at our armed forces.
In a new video by The Heritage Foundation, combat veteran Kerry Kachejian explains why U.S. military readiness is so crucial. He has first hand experience in the matter from his experience during the reconstruction of Iraq and Afghanistan. “Because this unit was organized, staffed, equipped and deployed so quickly, there was no spare military equipment for it,” Kachejian explained. Unable to acquire the necessary armored vehicles, his unit turned to ingenuity, courage and innovative ways to get the job done, all while coming under withering assaults from the enemy.
Kachejian’s story, which is continued in new book, “SUVs Suck In Combat,” illustrates the human impact of an ill-equipped military. He tells of being jolted by a one-thousand pound truck bomb, speeding at 110 mph through the streets of Iraq, ripping tailgates off SUVs and mounting machine guns in back, and men duct-taping their body armor to their vehicles to get even the smallest level of protection. On an individual level, the lesson is clear — our men and women soldiers are risking their lives in defense of freedom, and yet they’re ill-equipped to get the job done.
Americans Are ENTITLED To A Strong Defense!
The “war on poverty” was lost long before it even began during Johnson’s term in the White House. Feel good programs do little to alleviate the problems, and in many cases, do more harm. When a man, or woman, doesn’t have to rely on him/herself to provide for the family, then quite often, they will not even make the effort. Why should they? “The gubmint will take care of me!” This entitlement mindset has been the downfall of many communities, and especially the destruction of the family. Why worry about children you produce when there is someone else to take care of them? Why save for your retirement, when there’s that Social Security at the end of the road. Unfortunately, none of these programs work as well as was hoped, and have become the black hole from hell, creating a greater dependency on the government, and less self reliance. Our military, on the other hand, has been given the shaft, time after time. Perhaps no one person in Washington, whether elected, or government employee, should EVER earn more than the lowest paid in the military. Nor, should they have better health care than the families of our fighting men and women. When those who protect us has to apply for food stamps, rely on family for much needed equipment, yet those who decide their fate ride around in leased Lexus’ and Tahoes, at the taxpayers expense, there is something REALLY wrong!
Will Congress Defend Our Military?

It’s one thing to talk a good game about cutting spending, but it’s quite another thing to actually do something about it. This week, the House of Representatives has an opportunity to finally set some limits on Washington’s spending spree while also ensuring that the U.S. military has the resources it needs to defend America. Here’s the lay of the land this week in the nation’s capital.
On Thursday, the House is set to take up a spending reduction plan known inside the beltway as “reconciliation.” Under the measure, Congress would tackle two looming problems hanging over Washington’s head: the soaring cost of entitlement spending and the arbitrary defense cuts mandated by the so-called Budget Control Act (BCA) that was enacted last year.
Those issues are nothing to gloss over, even though some in Washington would like to pretend they’re not a problem. Since 1965, spending on Medicare, Medicaid and Social Security has more than tripled as a share of the economy, is continuing to grow at a rapid rate, hitting 9.7 percent of GDP this year, and will nearly double by 2050. Meanwhile, spending on defense has dropped over time, even when you add in the costs of the wars in Iraq and Afghanistan. As you can see in Heritage’s Federal Budget in Pictures, that means that spending on entitlement programs is crowding out spending on defense — a core constitutional function of government.

Socialism Rises Again

Last weekend, the people of France took a sharp turn to the left, and the rest of Europe may be on the brink of rebuking its recent tack toward fiscal responsibility. With Sunday’s election of French Socialist leader Francois Hollande, France has leapt backward toward the policies that have helped sink the continent in a sovereign debt crisis. Disturbingly, the big government platform Hollande campaigned on is all too familiar to the American people, and if the United States is not careful, it could suffer the same fate as its European allies.
Hollande sailed to victory by appealing to an electorate dissatisfied with having to face necessary cutbacks, proclaiming that he is “proud to have been capable of giving people hope again.” That brand of hope called for a change from President Nicolas Sarkozy’s relatively conservative policies — in his first term, Sarkozy worked to reduce the number of public sector employees, eliminate the 35-hour work week, reform the university system and cut taxes.

A Better Life for Julia

Her name is “Julia,” and if you haven’t seen her, she’s a colorful cartoon character invented by the Obama campaign to help spread the message of how women will “benefit” under the president’s policies. What it shows instead, though, is the president’s vision of America — that individuals need the federal government at each stage of their life, and that he deserves credit for making our lives even better.
In Julia’s story, as depicted in a cartoon slideshow, a faceless young American woman grows from birth to old age with the government at her side every step of the way. In the good times and the bad times, government is there to lift Julia up — and without government, Julia could not succeed in life.
This disturbing depiction of the president’s governing philosophy begins when Julia turns 3, at which time she is enrolled in the federally funded Head Start pre-school program. “Because of steps President Obama has taken to improve programs like this one, Julia joins thousands of students across the country who will start kindergarten ready to learn and succeed,” the cartoon explains. Never mind that Head Start is a proven failure. Despite Washington spending more than $167 billion on the program, a recent government study shows it has had no lasting benefits.
The Word Is Disgusted, NOT “Disappointing”
Obama is a liar. His administration is made up of liars. There has been NO truth spoken about the economy, and no, this is NOT Bush’s fault! Dude, pull up your big boy pants, and admit it……. YOU SUCK! You have NO idea how to run a lemonade stand, much less the economy of the United States of America! Socialism does not work. It has never worked, and it will never work. Wake up people! If this is the “change” you were looking for, there is no “hope”!
Weak Economy Disappoints Again

Every day, America waits for a brighter future to arrive — the promise of change that President Barack Obama made in 2009 when he set a benchmark for his success on the economy, remarking, “If I don’t have this done in three years, then there’s going to be a one-term proposition.” More than three years later, very little has changed. As today’s jobs report shows, the U.S. economy only added 115,000 jobs in April — well below expectations and far, far below what is necessary to drive the economy back to full employment.
Lackluster employment results dominate today’s report. It’s been three years under the Obama policies, and 12.5 million Americans remain out of work. No demographic group except black workers saw an improvement in their unemployment rate, and 13 percent of black workers remain unemployed. What’s more, the labor force participation fell to the lowest level since 1981 at 63.6 percent. Americans are fleeing this economy when at this stage workers should be returning to the labor force.
This shouldn’t surprise anyone. While little has changed with the economy, little has changed in President Obama’s failed policies. Rampant federal spending continues unchecked; the debt continues to grow; a monstrous tax hike is set to hit Americans on January 1, 2013, infecting the economy with renewed and debilitating uncertainty, and the country’s energy policy remains in shambles.

If you ran a business with $25 billion in losses over the last five years, $20 billion in annual losses projected in the coming years, and 80 percent of its locations losing money, do you think that your company would stay afloat? Should it be rescued with a bailout from its customers? Or should it change its business model, eliminate expenses, and innovate to be competitive in the marketplace? These are the questions facing Congress as it considers what to do about the ever-struggling United States Postal Service (USPS).
The USPS is indeed at a crisis point. Barring an intervention from Congress by May 15, USPS plans to start closing as many as 3,700 post offices. Those numbers might sound jarring, but in reality the post office closures (not including the processing centers) only save $200 million under USPS’s estimates, and only 4,500 employees would be “affected” — though many of them would be reassigned rather than let go. It’s only a small part of what’s needed to save the USPS.

Bin Laden Dead, but the Mission Remains

One year ago today, Seal Team Six landed in Abbottabad, Pakistan, and succeeded in bringing Osama bin Laden to ultimate justice. Though some may wish to bask in the glow of that success, now is not the time to celebrate or lay down arms. Bin Laden may be dead, but serious threats against the United States live on, both here in the homeland and around the globe.
President Obama, though, is using the occasion to boost his re-election efforts with a self-congratulatory campaign ad. Heritage’s James Carafano writes, “If Lincoln had spent the entire Gettysburg Address talking about himself, it wouldn’t have been quite that crass.” And last night, the president made a campaign stop in Afghanistan where he delivered a speech remarking that the “dark cloud of war” is breaking way to “the light of a new day on the horizon” as U.S. troops continue to be withdrawn from the country. “This time of war began in Afghanistan, and this is where it will end,” he declared.
